The Fifth Circuit Federal Court of Appeals, in Texas, overturned a lower court ruling that barred the US federal government from mandating COVID-19 vaccination to its employees. According to the appellate court, the obligation on federal employees will have to remain in effect pending the outcome of the judicial process.
The court ruled on the basis of a jurisdictional consideration: the lower court had in fact appealed the Civil Service Reform Act (Csra), which protects civil servants from unjust or coercive practices; however, the legal action was brought by 6 federal employees who contested the constitutional authority of the president to impose vaccination obligations.
