This was stated by the attorney general Francesca Nanni in relation to the negative opinion expressed in this morning's hearing held in the penitentiary department of the San Paolo hospital on the application for deferral of Alfredo Cospito's sentence.

"We - he explained - have asked on the basis of article 11 of the penitentiary order that Cospito, given his serious health conditions, can be placed in a stable manner in the San Paolo hospital ward where different respiratory maneuvers can be carried out . His conditions are undoubtedly unchanged and serious, but he is determined to continue. Calling it an interrogation seems misleading to me, it was rather an assumption of statements ”. The attorney general also added that “Cospito seemed to me a lucid and determined person, not necessarily determined to die. The subject of the hearing was not 41 bis, but it was discussed because he introduced it and wanted to explain his positions ”.

The request of the Attorney General is therefore to apply the same prison conditions of 41 bis to the San Paolo hospital. It would therefore not be a question of hospital detention, but of the application of the same regime, to be served in a detainee's department at a health facility, in the event that the precarious health conditions of the detainee are not destined to improve.
